The Potential Of Restorative Justice In Promoting Environmental Offenders’ Acceptance Of Responsibility

The air we breathe, the water we drink, and the land we live on are all potentially affected by environmental crimes. Such crimes encompass a wide range of illegal activity including pollution of land, air and water,

  1. breaching of an environmental protection licence,
  2. harming of flora and fauna,
  3. and the desecrating of Aboriginal cultural heritage.

 

These crimes can have a wide range of victims, including individuals, whole communities (present and future generations), the environment (such as plants, animals, and ecosystems) and commercial operators. Therefore, there must be effective strategies to respond to and prevent environmental crimes. The traditional criminal justice system is the most common way of responding to and deterring such crimes. The authors consider the traditional prosecution process achieving restorative justice.
